MEMBERSHIP ENROLLMENT
For the purpose of protecting the interests of property owners whose interests are threatened and/or adversely affected by the route ITC/METC have or may select for the 345 kV transmission line that it/they propose to construct between the Oneida substation and Sabine Lake, the undersigned hereby enrolls as a member of the Oneida – Sabine Lake Property Owners Association by contributing to a fund (“the Challenge Fund”) established for the purpose of retaining counsel and expert witnesses and defraying any expenses necessary to fund the challenge of any proposed or alternative route that would affect my property (“the Challenge”). The undersigned acknowledges and agrees to the following organizing principles and conditions:

Although the Challenge is intended to and may result in denying or modifying the route challenged, I acknowledge that neither the Association, its counsel, nor any expert retained to assist in the Challenge has made no promise, warranty, or assurance that the Challenge will succeed, and that the outcome of the Challenge will depend on a determination of its merit by the Michigan Public Service Commission.

The undersigned tenders with this enrollment an initial contribution to the Challenge Fund of $500.00 (“the Contribution”), for which this enrollment form, when countersigned by an Association organizer, is my receipt.

The undersigned will have the right to notice by email of steering committee and membership meetings, and the undersigned will have a right to vote on all measures subject to membership vote under the by-laws, a copy of which has been provided with this membership enrollment.

Once the Challenge Fund has reached $11,000 (“the threshold amount”), the undersigned agrees that the Contribution is non-refundable.

If the Challenge Fund does not reach the threshold amount by February 28, 2026, the Contribution will be refunded to the undersigned, less a prorated deduction for any reasonable amounts expended in the effort to organize the Challenge.

If the Challenge Fund reaches the threshold amount and the Challenge is mounted by retaining counsel, the Association may request additional voluntary contributions from members as necessary to fund the Challenge to a conclusion. A member’s decision not to make an additional contribution shall not, by itself, terminate membership or participation rights under the Association’s bylaws.

The undersigned acknowledges and agrees that the Association may use my Contribution(s) to retain counsel and experts and incur all expenses that the Association’s members and/or Steering Committee deem to be reasonably necessary to pursuing the Challenge, and that, regardless of the outcome of the Challenge, the Association’s officers, Steering Committee members, and members shall have no personal liability to the undersigned for actions they take in accordance with the bylaws.

The undersigned acknowledges that the Association will maintain information regarding its activities, governance documents, notices, and updates on a password-protected website or other restricted online platform accessible only to Association members (the “Association Website”). The address and access instructions for the Association Website will be provided to members once established and may be updated from time to time. The undersigned agrees that the Association Website will serve as a primary source of information for members. Information made available through the Association Website is intended for Association members only and is not intended for public distribution.

I acknowledge that Association information, updates, and governing documents will be made available through a password-protected, members-only Association website or platform, and that I understand access instructions will be provided once the site is established.
